====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.
The petitioner seeks bail in connection with Teghara P. S. Case No.403 of 2020, instituted for the offences under Section 394 of the Indian Penal Code. The petitioner is in custody since 06.01.2021 and he is a person with clean antecedents. Charge-sheet has been submitted in this case.
As per the prosecution case, four unknown miscreants assaulted the informant and his friend with knife and butt of the pistol and snatched Bolero Pick Up vehicle of the informant.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.29891 of 2021(2) dt.24-11-2021 2/3 petitioner is not named in the F.I.R. The name of this petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Mintu Rai. No incriminating article was recovered from the possession of the petitioner and till date the petitioner has not been put on T. I. Parade.
Learned counsel for the petitioner further submits that similarly situated co-accused Govind Kumar Rai has been granted bail by a Bench of this Court vide order 02.09.2021 passed in Cr. Misc. No.33362 of 2021. Learned A.P.P. vehemently opposes the bail application.
Considering the fact that the petitioner has clean antecedent and charge sheet has been submitted in the case and the similarly situated co-accused has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Begusarai in connection with Barauni P. S. Case No.403 of 2020, subject to condition that in the event, the
Patna High Court CR. MISC. No.29891 of 2021(2) dt.24-11-2021 3/3 petitioner after commencement of trial fails to appear before the Court below on two consecutive dates, the learned Court below shall be at liberty to cancel his bail bonds. The application stands allowed.
