JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 At the outset, learned counsel for the petitioners submits that petitioners no. 1 & 2 namely Vikash @ Vikash @ Malik Chauhan and Mevalal Chauhan have been arrested and as such, he seeks permission to withdraw this petition, so far as petitioners no. 1 & 2 are concerned.

Accordingly, in respect of petitioners no. 1 & 2, this petition is dismissed as withdrawn.

Sole petitioner i.e. petitioner no. 3 (Gayatri Devi) apprehends her arrest in a case registered for the offence under Sections 341, 323, 308, 504 and 506/34 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, all the accused persons, armed with iron

No.22023 of 2023(2) dt.06-07-2023 2/2 rod, lathi and danda, assaulted informant and her daughter, as a result of which, both of them received injury It is submitted on behalf of petitioner that there is general and omnibus allegation against petitioner no. 3. Specific allegation of giving rod blow is against co-accused Vikash and Mevalal Chauhan. Petitioner is lady and has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the general & omnibus nature of allegation and clean antecedent of petitioner, let the petitioner no. 3 namely Gayatri Devi, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Gaya in connection with Atri P.S. Case No. 248 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
