The petitioner is languishing in custody since 23.11.2018 in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. The prosecution case is that the petitioner misappropriated Rs.14,000/- which was provided to him for construction of his house under the Indira Aawas Scheme. It is submitted by learned counsel for the petitioner that the alleged construction has been completed and a certificate to that effect has also been issued by the local representative. It is

A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP for the State submits that the accusation is specific against the petitioner.

Considering the nature of accusation and the fact that the investigation has already been concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Banka in connection with Amarpur P.S. Case No.115 of 2005.
