JUSTICE SANJAY PRIYA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hilsa P.S. Case No. 363 of 2018 instituted for the offence under Section 3/4 of Prevention of Child Marriage Act.

Counsel for the petitioner submits that petitioner has been made accused in the instant case merely on suspicion. In the written report it is alleged that informant has got information that marriage of minor girl namely, Baby Kumari has been solemnized with the petitioner forcibly. The informant along with Lady Constable rushed there. The girl has stated that she was not ready for marriage. Her father was getting her marriage solemnized with this petitioner.

Petitioner is in custody since 5.7.2018

Patna High Court Cr.Misc. No.56737 of 2018 (2) dt.28-09-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, in connection with Hilsa P.S. Case No. 363 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
