ANJANA MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner, Informant and learned counsel for the State.
The petitioner apprehends his arrest in connection with Town P.S. Case No. 676 of 2014 registered for the offences punishable under Sections 323, 324, 325, 326, 302 and 120(B)the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is the Superintendent of the Child Remand Home, Muzuffarpur and during the period, the inmate, namely, Rupesh Kumar @ Anup Kumar died, he was on leave.
Learned counsel for the informant has drawn my attention to the report of the Principal Magistrate, Juvenile Justice
Patna High Court Cr.Misc. No.34122 of 2015 (3) dt.08-10-2015 Board, Muzuffarpur dated 15.09.2014 in which it has been categorically stated that when he visited the remand home alongwith one social worker on 14.08.2014, the condition of the inmate, namely, Rupesh Kumar @ Anup Kumar was satisfactory. What happened thereafter, is mystery. However, it appears that so far as the present petitioner is concerned, he was on leave between 14.08.2014 to 17.08.2014.
Learned counsel for the State on perusal of the case diary though opposes the prayer but could not be able to controvert the submissions advanced on behalf of the petitioner. Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzuffarpur in connection with Town P.S. Case No. 676 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
