The Petitioner seeks bail in Bishanpur P.S. Case No. 86 of 2016 registered for the offence punishable under Sections 363, 366A, 120B/34 of the Indian Penal Code and Sections 6, 8, 10 and 17 of the POCSO Act.
Allegation against the petitioner is of kidnapping two minor daughters of the Informant.
It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case. Similarly, situated co-accused person has been granted bail by a coordinate bench of this Court vide order dated 15.03.2017 in Criminal Miscellaneous No. 2616 of 2017. Petitioner has got
Patna High Court Cr.Misc. No.46755 of 2017(3) dt.05-11-2018 2/2 no criminal antecedent and is in custody since 27.09.2016. Considering the fact that petitioner has been named by the victim girl in her statement under Section 164 of the Cr.P.C, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt/production of a copy of this order. (S.
