Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 47(A) of the Excise Act. It is said that 55 sachets of 200 ml. country made liquor was seized from his custody. Petitioner was not apprehended at the spot. It is submitted that his antecedent is absolutely clean.
Let petitioner, named above, surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order in the court below and thereafter his
Patna High Court Cr.Misc. No.41292 of 2014 (2) dt.10-04-2015 2/2 antecedent be verified, if his antecedent is absolutely clean, he be admitted to the privilege of bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Gaunaha P.S. Case No. 25 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Until such verification, no coercive steps be taken against the petitioner.
