Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is that the petitioner and other F.I.R named accused persons assaulted the brotherin-law of the informant who succumbed to the injuries. It is submitted by learned counsel for the petitioner that though petitioner is named in the First Information Report but admittedly neither the informant nor the sons of the deceased are eye witness of the actual assault. The informant claimed that victim disclosed him that he was badly assaulted by petitioner and Malo Devi but the alleged statement of the victim as claimed by the informant does not
Patna High Court Cr.Misc. No.34276 of 2015 (2) dt.25-08-2015 2/2 get corroborated by the postmortem report which reflects no external injury. It is further submitted that doctor could not ascertain the cause of death and viscera has been kept reserved. Moreover considering the above facts co-accused Malo Devi has been granted anticipatory bail vide Cr. Misc. No. 12516 of 2015.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Fatehpur P.S. Case No. 316 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
