2. The defect, as pointed out by the office notes dated 04.04.2025, has already been removed.

3. Heard learned counsel for the petitioner and learned A.P.P. for the State.

4. The petitioner has preferred this application for grant of regular bail in connection with Keoti P.S. Case No. 8 of 2025 dated 03.02.2025 registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

5. As per the prosecution case, total 02 litres of

Patna High Court CR. MISC. No.23145 of 2025(2) dt.16-04-2025 2/3 country made illicit liquor alongwith utensils for preparation of liquor is said to have been recovered from the Bathan of the petitioner.

6. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from his possession. The petitioner is not involved in selling the illegal liquor. He has no concern with the alleged offence. The petitioner has three criminal antecedents as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 03.02.2025.

7. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

8. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge, Sheikhpura in connection with Keoti P.S. Case No. 8 of 2025.
