JUSTICE SUDHIR SINGH ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case instituted under Section 353, 307, 401, 411, 414, 420, 467, 468, 216(A) and 120(B) of the Indian Penal Code.
The allegation against the petitioner is that a raid was conducted in his house as well as in the house of co-accused Amit Sah, where several Identity Cards, theft and looted mobiles are said to have been recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.04.2016. The charge sheet has been submitted in the present case. There is no allegation of
Patna High Court Cr.Misc. No.36276 of 2016 (3) dt.25-10-2016 tampering of witnesses alleged against the petitioner. Altogether six persons are named in the F.I.R. including the petitioner. The main allegation is against co-accused Ramanand Kumar Paswan. There is no specific allegation has been made against the petitioner. The other co-accused have been granted bail vide Cr. Misc. No. 40400 of 2016, Cr. Misc. No. 28779 of 2016, Cr. Misc. No. 12731 of 2016 and Cr. Misc. No. 37209 of 2016 by another co-ordinate Benches of this Court.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 18 of 2016, corresponding to G.R. No. 294 of 2016. (Sudhir Singh, J.) Amit/- U T
