2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3 . It is alleged that 375 ml foreign liquor was recovered from possession of co-accused person who disclosed the name of this petitioner as one who fled away from the place of occurrence .
4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on the basis of confessional statement of other co-accused person . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected with the
Patna High Court CR. MISC. No.19880 of 2025(2) dt.19-04-2025 2/2 alleged occurrence . Petitioner claims clean antecedent. 5 . Learned APP for the State vehemently opposed the bail application .
6. Considering the facts of the case and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned district and Additional sessions Judge V - cum- special Judge Excise Bihar Sharif Nalanda in connection with Chiksaura P. S. Case No. 184 of 2024 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
