JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Learned counsel for the petitioners informs this Court that the petitioner no.1 Awadhesh Singh has been arrested during the pendency of this application and, therefore, this application to the extent it relates to petitioner no.1 above named has become infructuous.
This application relates to petitioner no.1 is dismissed as having become infurctuous.
Learned counsel appearing on behalf of the petitioners submits that there is property dispute between the parties which is the reason behind the institution of the present First Information Report. Learned counsel for the petitioners further submits that
Patna High Court Cr.Misc. No.42178 of 2014 (3) dt.16-04-2015 petitioner no.1 has been granted regular bail and petitioner nos. 2 and 3 are the sons of the petitioner no.1.
In view of the submissions as above, let petitioner nos. 2 and 3, namely, Santosh Kumar and Dhiraj Kumar @ Diwakar in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hilsa, Nalanda in Hilsa P.S. Case No. 130 of 2014, subject to the conditions as laid down under Section 438 (2) of the code of Criminal Procedure.
