The petitioner is apprehending arrest in a case registered for the offences punishable under sections 177,181,193 and 420 of the Indian Penal Code.
It is alleged against the petitioner that he filed nomination during elections of Panchayat Samiti but did not disclose about the pendency of Complaint Case No. 337C of 1990 filed with accusation under sections 406 and 420 IPC. It is submitted by the learned counsel for the petitioner that due to bonafide mistake the petitioner could not
Patna High Court Cr.Misc. No.35150 of 2015 (2) dt.03-09-2015 2/2 disclose the same as the said complaint was filed about 20 years prior to the filing of the nomination.
Considering the aforesaid facts, in view of this court, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Pipra P.S. Case No. 199 of 2014 pending in the court of learned JM, Supaul.
This application is disposed of with the aforesaid observation/direction.
