The petitioners, in the present case, are seeking anticipatory bail in connection with Shambhuganj P.S. Case No. 100 of 2017 dated 19.06.2017, registered for offences alleged under Sections 467, 468, 471, 420 and 120 (B) of the Indian Penal Code. Learned counsel for the petitioners submits that the present criminal case has been lodged by the own uncle of these petitioners after rejection of his Mutation Appeal No.76/16-17 on 17.12.2017. It is further submitted that in this case a final form was submitted by the police saying that it is a case of land dispute, however, the learned Court below has taken cognizance and
Patna High Court Cr.Misc. No.54524 of 2018 (2) dt.08-10-2018 2/2 proceeded against these petitioners. The petitioners are having no criminal antecedent.
Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail.
Considering the facts and circumstances of the case as also the materials available on the record, where it appears that these petitioners are own nephews of the informant and the dispute between them is over a piece of land in which both the parties are claiming their possession, let the petitioners, above named, be enlarged on bail in case of their arrest or surrender within four weeks from today, on their furnishing bail bond of Rs.15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 100 of 2017, subject to the conditions U/S 438(2) Cr.P.C. (Rajeev Ranjan Prasad, J) R.R.Ojha.
