2. The petitioner has preferred this application for grant of regular bail in connection with Tekari P.S. Case No. 604 of 2023 dated 06.10.2023 registered for the offences punishable u/ss 25(1-A), 25(1-AA), 25(1-b)2/26(3)/ 35 of the Arms Act.

3. As per the prosecution case, leth machine, drill machine, one piece half made pistol, half made barrel, cutter machine, cutter grinder machine iron made printing machine and several machines were recovered from M/s Baba Furniture of the co-accused, Mukesh Kumar. Police apprehended two persons who disclosed their name as Bittu Kumar @ Md. Anwar Khan (petitioner ) and Verru Kumar.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has transpired in this case merely on suspicion. The proprietor of the Baba Furniture is Mukesh Kumar and the petitioner is only worker of the said shop and he has no concern with the alleged recovery. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.10.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Tekari P.S. Case No. 604 of 2023.

7. The application stands allowed.
