ANJANA MISHRA ORAL ORDER 15-12-2016 At the outset, Learned counsel for the petitioners submits that during the pendency of this application, the petitioner no. 4 has been taken into custody and as such, the application against him has become infructuous.

Accordingly, the application against the petitioner no. 4 is dismissed being infructuous.

Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Nawada Nagar ( Kadirganj) P.S. Case No. 295 of 2016 for the offences registered under Sections 341, 323, 324, 307, 379/34 of

Patna High Court Cr.Misc. No.32543 of 2016 (2) dt.15-12-2016 the Indian Penal Code.

Learned counsel for the petitioners submits that the entire allegation has been made against the petitioner only on account of some dispute. It is further submitted that the injuries purported to have been inflicted on the person of the injured, was found to be simple in nature and are not attributed to these petitioners.

Considering the aforesaid facts and circumstances of the case, let the petitioner nos. 1, 2 and 3 namely, Binod Kumar Chauhan @ Binod Chauhan, Jageshwar Chauhan and Sanjay Chauhan, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada Town (Kadirganj) P.S. Case No. 295 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
