Report, as called for from Special Judge SC/ST, Begusarai, has already been received and from perusal of the report of learned Special Judge, it would appear that Cheriabariyapur P.S. Case no. 133/2015 was registered for the offences punishable under sections 302,201/34 of the Indian Penal Code but after investigation, charge sheet was submitted for the offences punishable under sections 302,201/34 of the Indian Penal Code and section 3 (2) (V) of the SC/ST (Prevention of Atrocities) Act and under the same section, charges have been framed.

Therefore, in the aforesaid circumstance, this petition does not appear to be maintainable. Accordingly, this petition stands dismissed being not maintainable.
