Permission is accorded.

This application is dismissed as withdrawn against petitioner nos.1 and 2.

So far as rest of the petitioner are concerned, the instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Jagdishpur P.S. Case no. 490 of 2021 instituted for the offence

Patna High Court CR. MISC. No.19662 of 2022(2) dt.28-09-2022 2/3 under Sections 341, 307/34 of the Indian Penal Code and section 27 of the Arms Act.

As per allegation in the FIR, while the informant and his cousin brothers were going to their house from a vehicle, in way the accused persons made firing due to which the glass of vehicle was broken.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. There is case and counter case. No specific allegation against the petitioners that they had made firing on the vehicle and no any person sustained injury by opening fire. There is general and omnibus allegation against the petitioners. They have got no criminal antecedent.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners nos. 3 to 5 on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Jagdishpur P.S. Case no. 490 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned
