Petitioners apprehend their arrest in a case filed under Sections 379, 414/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per the allegation, 40 persons tried to commit theft of the coal from the railway wagon, however, they could not succeed. It is submitted on behalf of the petitioners that they were not on the spot but due to the village politics, they have been falsely implicated in this case. It is also submitted that the petitioners are having clean antecedent.
Having regards to the facts and circumstances of the
Patna High Court Cr.Misc. No.37173 of 2014 (2) dt.27-03-2015 2 / 2 case, in the event of arrest/surrender within a period of six weeks from today in Kahalgaon P.S. Case No.463/13, the above named petitioners, Ranbir Yadav, Sanjay Yadav, Basuki Tanti and Fulchan Mahaldar shall be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure. Further, if the petitioners, after his release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
