====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-09-2018 Heard learned counsels for the petitioners and the State.

Petitioners seek bail in connection with Special Case No. 6221 of 2018, arising out of Rail P.S. Case No. 222 of 2018 (Patna Junction P.S. Case No. 222 of 2018) registered for the offence punishable under sections 20/22/29 of the N.D.P.S. Act and Section 30(a) of the Bihar Excise Amendment Act, 2016.

Learned counsel appearing for the petitioners submit that merely on suspicion petitioners have falsely been implicated in this case. Petitioners have no concern with liquor in question. Moreover, similarly situated co-accused persons have been granted bail by different Co-ordinate Bench of this Court vide order dated 20.09.2018, 20.09.2018 and 12.09.2018

Patna High Court Cr.Misc. No.58810 of 2018(2) dt.28-09-2018 2/2 passed in Criminal Misc. No. 58699 of 2018, 54407 of 2018 and 56913 of 2018 respectively. Petitioners have no criminal antecedent and are in custody since 05.07.2018. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge of Excise, Patna in connection with Special Case No. 6221 of 2018 arising out of Rail P.S. Case No. 222 of 2018 (Patna Junction P.S. Case No. 222 of 2018).
