The Petitioner seeks regular bail in connection with Barauni P.S.Case No. 97 of 2018, registered for offences punishable under Sections 392 of the Indian Penal Code. As per F.I.R. allegation against the petitioner is of snatching the Pick-up van along with mobile and cash etc. Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and later on the name of the petitioner transpires on the confessional statement of coaccused, Kundan Kumar. It is further submitted that in one case the petitioner has been acquitted and in other case, he is already on
Patna High Court Cr.Misc. No.63862 of 2018 (2) dt.25-10-2018 2/2 bail and he is in custody since 19.05.2018.
Heard learned A.P.P. who opposes the prayer for bail. In view of the discussions made above, this application is disposed of with direction to the Court below to release on bail to the petitioner after completion of the period of six months of his custody to his own satisfaction on condition that he will co-operate in disposal of trial.
With the aforesaid observation, the instant petition is disposed of.
