20-09-2018 Heard Sri Suresh Prasad Singh, learned counsel assisted by Smt. Kumari Rashmi, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, apprehending his arrest in Ali Nagar P.S. Case No. 58 of 2018 registered for offence under Section 7 of the Essential Commodities Act, 1955, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that the petitioner is P.D.S. dealer and only accusation has been made that on inspection, excess stock was found in the shop of the petitioner.
Considering the nature of accusation, in the event of his arrest or surrender within a period of six weeks from today,
Patna High Court Cr.Misc. No.58723 of 2018(2) dt.20-09-2018 2/2 let the petitioner namely Mahesh Prasad Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned I/c S.D.J.M., Benipur, Darbhanga in connection with Alinagar P.S. Case No. 58 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
