====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 13-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 19.12.2018 in a case for the offence registered under Sections 363 and 366 of the IPC.

The prosecution story, in brief, is that on 22.09.2018, the informant went for his work after giving medicine to his sick wife, and told his mother not to disturb her. When the informant's mother went to get awaken her in the room at about 5.00 P.M. she could not found her in the room. On search, informant's wife could not be traced out, She taken away with gold ornaments and cash of Rs. 1,50,000/-and fled away. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner has remained in custody for more than six months. The victim has already been recovered. In 164 Cr. P.C. statement, no allegation of sexual abuse is alleged by the victim against the petitioner.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Kishanganj, in connection with Kishanganj P.S. Case No. 608 of 2017.
