JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

For an occurrence dated 11.08.2015, wherein Neha Kumari, allegedly, aged about 15 years was enticed away, informant Uma Shankar Prasad, her father filed written report on 23.11.2015 against the petitioner along with his other family members, without any explanation.

From the impugned order, it is evident that date of birth of victim happens to be 11.03.1998 and on account thereof, at the time of occurrence she was approaching 18 years. In the aforesaid background, when her statement recorded under Section 164 of the Code of Criminal Procedure (Annexure-2) has been gone through, it is evident that she on her own volition joined

Patna High Court Cr.Misc. No.29197 of 2016 (2) dt.25-07-2016 2/2 hands with the petitioner and was pregnant at that very moment. She had further shown her inclination to stay at her Sasural. Accordingly, petitioner Tarun Kumar Patel is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge1st-cum-Special Judge, West Champaran at Bettiah in connection with Majhauliya P.S. Case No. 509 of 2015.
