The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code, 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act and 27 of the Arms Act.

It is alleged that the accused persons came to the shop of the informant and abused him by calling caste name for not getting up from chair on arrival of petitioners, made assault and took out Rs. 1,000/- from his pocket.

It is submitted by the learned counsel for the petitioners that petitioner is a teacher and there is some dispute with the Director of the school who set up the present informant.

It is further submitted that the

Patna High Court Cr.Misc. No.34568 of 2015 (2) dt.25-08-2015 informant has retracted from the initial version and filed a petition to that effect before learned court below. The same has been brought on record as Annexure-2 series. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with SC/ST (Bhabhua) P.S. Case No. 29 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
