The petitioner is apprehending her arrest in a case in connection with Minapur P.S. Case No. 168 of 2022 dated 15.4.2022 registered for the offences punishable u/s 147, 148, 341, 342, 323, 307, 224, 353, 504 of the Indian Penal Code. As per the prosecution's case, the informant along with other police personnel went to village Puraina, P.S. Minapur to arrest some accused persons against whom bailable warrant were issued and also to raid illegal liquor trade. It is

Patna High Court CR. MISC. No.22707 of 2023(2) dt.24-06-2023 2/3 further alleged therein that accused persons namely Rajeev Ram and Mantosh Ram wanted in Minapur P.S. Case No. 436/2019, U/s- 342, 338, 307, 325, 302/34 IPC were arrested and then the other co-accused persons forming an unlawful assembly, surrounded the police team and attacked them and got the apprehended accused Rajeev Ram set free. It is further alleged therein that the mob also attacked ASI Rajeev Kumar with the intention to kill him and also obstructed the police personnel to discharge their official duties.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Learned counsel has further submitted that no overt act has been attributed against the petitioner and the petitioner is a poor labourer. The petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner. Considering the aforesaid facts and circumstances, let the above named petitioner, who is lady, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.22707 of 2023(2) dt.24-06-2023 3/3 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Muzaffarpur, in connection with Minapur P.S. Case No. 168 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
