The petitioner being the President of PACS, Ekawana is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 of the Indian Penal Code.

The prosecution case is that during the paddy procurement years 2013-14 original documents of the farmers were not tallied with the photo copies, like the land receipt etc.. Subsequently, land receipts were found forged and tampered.

It is submitted by the learned counsel for

Patna High Court Cr.Misc. No.35902 of 2015 (2) dt.04-09-2015 2/2 the petitioner that the duty of verifying or tallying the documents was not of the petitioner. Accusation is not specific against the petitioner, who has no criminal antecedent and statement to that effect has been made in paragraph 3 of the petition. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 161 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
