The petitioner apprehends his arrest in Town P.S. Case No. 311 of 2016 registered for the offence punishable under Section 406 of the Indian Penal Code.

The informant alleged that the petitioner being the driver of Bolero jeep bearing registration no. BR33J-6830 took the vehicle but did not return the vehicle and the vehicle is still missing.

Learned counsel for the petitioner submits that the petitioner was the driver of the vehicle. The informant did not pay the wages of the petitioner and lodged the case on false allegation but, from perusal of the case diary it appears that the vehicle is still missing.

Patna High Court Cr.Misc. No.10570 of 2017 (3) dt.29-06-2017 2/2 Considering the facts aforesaid and the fact that it was the petitioner who took the vehicle of the informant and did not return, I am not inclined to enlarge the petitioner above named on anticipatory bail.
