JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Parbatta P.S. Case no. 70 of 2017, registered under Sections 147, 149,323, 324, 224, 307, 337, 379, 353, 333, 427 and 504 of the Indian Penal Code.
This case has been registered by the Assistant SubInspector of Parbatta Police Station. As per the F.I.R. it appears that petitioners and other named in the F.I.R. obstructed the Police party while executing the warrant against one Ravindra Mishra. From perusal of the F.I.R. it appears that the allegation against these two petitioners is that they were opposing the arrest of Ravindra Mishra, but there is no overt act against the petitioners. Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.19727 of 2017 (2) dt.29-05-2017 2/2 let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the receipt/production of the order, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 70 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
