JUSTICE AMARESH KUMAR LAL ORAL ORDER 27-03-2015 Heard the learned counsel for the petitioners and the learned counsel for the State.

The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant for non-fulfillment of demand of dowry of motorcycle.

It is submitted that the petitioners are the mother-inlaw and father-in-law of the deceased. The occurrence has not taken place within seven years of the marriage. There is no specific allegation of overt act against the petitioners. In similar facts and circumstances, the co-accused Jitendra Singh has been

Patna High Court Cr.Misc. No.42163 of 2014 (2) dt.27-03-2015 2/2 granted bail vide Cr. Misc. No.44144 of 2014. The petitioners have no criminal antecedents.

Considering the facts and circumstances of the case, let the petitioners, above-named, be released on bail in the event of arrest or surrender within a period of four weeks on furnishing bail bonds of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Bhagwanpur P.S. Case No.64 of 2014 subject to the condition as laid down under Section 438

(2) of the Code of Criminal Procedure and the other following conditions :

One of the bailors will be the close relative of the petitioners.

2.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
