2. The petitioner, a Nursing and Paramedical Institute through its Secretary has invoked the jurisdiction of this Court seeking a direction upon the respondents, especially the Director-in-Chief (Nursing), Health Department, Government of Bihar to grant and issue necessary order of Permanent
Patna High Court CWJC No.5739 of 2026 dt.28-07-2026 2/3 Recognition in favour of the Petitioner's Institution for conducting A.N.M. (Auxiliary Nursing Midwifery) course, G.N.M. (General Nursing Midwifery) course and B.Sc. (Bachelor in Science) Nursing course.

It is submitted that undisputedly the institution fulfills each and every criteria for permanent recognition and in terms with the Nurses Training - Recognition, Affiliation and Conduct of Examination and School of Nursing Rules, 1997, the institution was inspected by a duly constituted inspection team on 14.01.2024 and after verification of the record of the institution, in question, a recommendation has also been made for grant of permanent recognition on 16.01.2024. Nevertheless, any final decision has been taken till date.
4. Learned Advocate for the State and other respondents seek a short adjournment to apprise this Court with regard to the present position.

Considered the limited grievance of the petitioner, as also the materials available on record, especially, the mandate of the Rules, 1997 that after receipt of the inspection report in relation to an institute by the inspecting team the State Government is bound to take a final decision within a period of six months. However, in the case at hand more than two years
Patna High Court CWJC No.5739 of 2026 dt.28-07-2026 3/3 have been lapsed, no final decision has been taken, keeping the fate of the institution at lurch. In view thereof, this Court deems it fit and proper to direct the respondent no. 3 to take appropriate decision in the matter of recognition of the Petitioner's Institution in the light of the inspection report and the recommendation made in favour of the institution, preferably within a period of four weeks from today.
6. With the aforesaid direction, the present writ petition stands disposed off.
7. Suffice it to observe that the authority shall adhere to the time stipulated hereinabove in order to avoid any further sufferings to the incoming students of ongoing/subsequent academic sessions and/or the institution.
