The petitioner apprehends his arrest in Madhuban P.S. Case No. 54 of 2013 registered under sections 363, 366(2), 506/34 of the Indian Penal Code. Earlier case diary was called for in this case which has been received.

Learned counsel for the petitioner submits that malicious allegation has been made against the petitioner stating that he had kidnapped the victim girl. In fact this is case of love affairs and the girl has fled away with the petitioner to Punjab and they were living there as wife and husband.

Learned counsel for the State after perusal of the

Patna High Court Cr.Misc. No.34770 of 2015 (3) dt.02-12-2015 2/2 case diary submits that the victim girl has been kidnapped by the petitioner and after recovery her statement has been recorded under section 164 Cr.P.C. in which shay has stated that she has been taken away by the petitioner to Punjab on the point of knife and she was raped there.

Considering the entire facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer is rejected.
