JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
The accusation against the petitioner is that he along with other accused forcibly kept the bag containing cash and original certificates of the informant and demanded Rs. 1,50,000/- from him. In course of investigation, the aforesaid bag was recovered from the house of the petitioner but submission on behalf of the petitioner is that there was some dispute between petitioner and informant on the point of payment of rent as it is

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 213 of 2016.
