ANJANA MISHRA ORAL ORDER 08-01-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 498(A), 323, 379, 364 of the Indian Penal Code read with Section 3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioners submits that the entire case is false and malicious and the petitioners have been named only to harass them and the girl in question was of questionable character and had herself run away with one Ajit Ram who she subsequently married.
Patna High Court Cr.Misc. No.15357 of 2015 (4) dt.08-01-2016 P2/2 Learned counsel appearing on behalf of the informant submits that in fact these petitioners together conspired and sold off the O.P. No. 3 to one Ajit Ram and he took her to Delhi whereafter committed illegalities with her, subjected her and forced her into prostitution. Learned counsel further produces us a statement made by the victim girl under Section 164 of the Cr. P.C. in which he has clearly indicated the complicity of all these petitioners in the alleged offence.
Considering the entire facts and circumstances and the statement of the victim girl, I am not inclined to grant bail to these petitioners in Runnisaidpur P.S. Case No. 62 of 2015 and is, accordingly, dismissed.
