JUSTICE RAKESH KUMAR ORAL ORDER 16-08-2016 Heard Sri Amresh Kumar Sinha, learned counsel who was assisted by Sri Rampravesh Nath Tiwary, learned counsel for the petitioner and Sri Chandrasen Prasad Singh, learned A.P.P. The sole petitioner, who is in custody in G.R.P. Patna Case No. 86 of 2016 registered for the offence under section 47(a) of the Excise Act since 13.4.2016 has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on accusation of recovery of toddy the petitioner has been made accused.
Patna High Court Cr.Misc. No.32036 of 2016 (2) dt.16-08-2016 2/2 Learned A.P.P. has opposed the prayer for bail. He submits that huge quantity of toddy has been recovered. Keeping in view the nature of accusation and period of custody, let the petitioner Ganauri Chaudhary @ Ganori Chaudhary @ Ganour Chaudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Patna in connection with G.R.P. Patna Case No. 86 of 2016.
