For the Respondent/s : Mr. J.P. Kishore, AC to SC-13 =========================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 18-10-2016 Heard learned counsel for the petitioners and learned counsel for the State.

In the present case petitioners are seeking regularisation in service as it has been claimed that they have been working on contract basis for more than five years but have not been regularised in service.

The counsel for the State has filed a counter affidavit where the plea has been taken that as petitioners are the contractual employees, their services were dispensed with and whenever there will be a proper selection, their cases will be considered and benefit of past service will be given to them.

In such view of the matter, the relief that has been sought cannot be given to the petitioners. However, liberty is given to the petitioners that if they are feeling aggrieved by the action of the District Magistrate, they will take action in accordance with law.

Patna High Court CWJC No.9446 of 2013 dt.18-10-2016 3/3 Accordingly, this petition is dismissed.
