JUSTICE SUDHIR SINGH ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 19.03.2016 in connection with Gopalpur P.S. Case No. 148 of 2015 registered for offences under Sections 120B, 302 and 201 of the Indian Penal Code.

The prosecution story, in brief, is that on information that the accused persons, who were husband and in-laws of the deceased, have killed Prabha Devi, the deceased by giving poison and concealed the dead body. On 30.11.2015 at 7.45 A.M. from the sugarcane field of Radhu Singh, the dead body of the deceased was recovered.

On behalf of the petitioner, it is submitted that the petitioner

Patna High Court Cr.Misc. No.29124 of 2016 (3) dt.01-09-2016 2/2 is in custody since 19.03.2016. Charge-sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner is the father-in-law of the deceased. The alleged occurrence is said to have taken place after 12-15 years of the marriage. No motive has been alleged against the petitioner. Petitioner is separate from mess and property of the husband of the deceased.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 148 of 2015.
