2. The petitioner seeks regular bail in connection with Siswan P.S. Case No. 388 of 2025 registered for the offence under Sections 137(2), 140(3) of the BNS.

3. As per the prosecution case, the petitioner is suspected of killing the deceased.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioner is in custody since 25.12.2025 and the petitioner has no criminal antecedent. He also submits that the petitioner had no dispute with the deceased as the money which was taken by him has already been returned.

5. Learned counsel for the State and informant have opposed the application of the petitioner and have submitted that this is a case of last seen.

6. Considering the facts of the case as well as the fact that nothing has come in the case diary to connect the petitioner with the crime and also considering the period of custody of the petitioner, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Siswan P.S. Case No. 388 of 2025, subject to the condition that the petitioner will co-operate in the trial.
