The petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 270 of 2016, registered under Section 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016, pending in the court of the Chief Judicial Magistrate, Bhagalpur.

The accusation is of recovery of 8 bottles, each containing 375 ML, 8 bottles, each containing 180 ML, India made foreign liquor to the house of petitioner and 20 pouches, each containing 200 ML from the house of Sonu Kumar, son of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.4553 of 2017 (3) dt.27-03-2017 2/2 suspicion and alleged India made foreign liquor and country made liquor has not been recovered from the conscious possession of the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
