The petitioners, namely, Ram Deyal Sao @ Ram Dayal Sao, Sanjay Sao, Satendra Sao and Nepali Sao who apprehend their arrest in Kurtha P.S. Case No.47 of 2014 under Sections 147, 148, 149, 379, 323, 324, 341, 307 and 504 of the Indian Penal Code.

The learned counsel for the petitioners submitted that there are 15 accused persons against whom there is omnibus allegation of assault. A counter-case is also pending which has been filed by the petitioner's party under Section 307. There is

Patna High Court Cr.Misc. No.39001 of 2014 (2) dt.27-03-2015 land dispute between the parties and title suit is pending between the parties regarding the land.

In view of the above facts and circumstances of the case that there is case and counter-case under Section 307 I.P.C. and from perusal of the F.I.R., it appears that there was free fighting between the parties, I direct the petitioners named above to surrender before the court below within one month from today and on their so surrendering, the petitioners shall be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K.Rai, learned Judicial Magistrate 1st Class, Jehanabad in connection with Kurtha P.S.
