Apprehending his arrest in Karpi P.S. No. 61 of 2013 instituted under sections 307 and other allied sections of the IPC, the petitioner has filed the present application for grant of anticipatory bail.
Counsel for the petitioner places the FIR in order to highlight two facts. Firstly, owing to the land disputes the occurrence had taken place and secondly that two persons namely Dhananjay Yadav as well as the petitioner are said to have assaulted both the injured i.e. the informant and his uncle by Garansa. It is submitted that the doctor found only solitary injury on the person of the two injured. It was however found simple in
Patna High Court Cr.Misc. No.36536 of 2014 (2) dt.27-03-2015 2 / 2 nature. Referring to the order dated 28.01.2014 passed in Cr. Misc. No. 40912 of 2013 it has been submitted that the co accused Dhananjay Yadav considering the background of dispute and nature of the injury sustained by the injured has been released on anticipatory bail on certain conditions.
In the facts and circumstances of the case, in the event of arrest/surrender within four weeks from today, the petitioner above named shall be released on bail on furnishing bail bonds of Rs. 10,000/- each, with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in Karpi P.S. Case No. 61 of 2013 on conditions that one of the bailors shall be own/close family member of the petitioner. In the event of framing of charger the petitioner shall continue to appear in person on the date fixed at trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bond and secure his arrest in accordance with law.
