JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2016 Heard Sri Sanjay Kumar, learned counsel for the petitioner and Sri Gopesh Kumar, learned A.P.P. The sole petitioner, who is in custody in Barun P.S. Case No. 16 of 2016 registered for the offence under section 394/ 411 of the Indian Penal Code , has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation petitioner was arrested and he was assaulted also. He submits that there was some altercation at the petrol pump in between the petitioner and staff of the petrol pump and thereafter petitioner was apprehended and assaulted. Showing a case of robbery the petitioner was arrested. On this very ground a prayer has been made to extend the privilege of bail.

Patna High Court Cr.Misc. No.32220 of 2016 (2) dt.19-08-2016 2/2 Sri Gopesh Kumar, learned A.P.P. opposing the prayer of bail submits that petitioner is having criminal antecedent and he was arrested on the spot while fleeing away with looted cash and other articles.

In view of nature of accusation as well as antecedent of the petitioner, I am not inclined to extend the privilege of bail. The petition stands dismissed.
