The petitioner prays for anticipatory bail in connection Sherghati (Gaya) complaint case no. 636 of 2008 registered for the offence punishable under various sections of 498A of Indian Penal Code and Section 4 of Dowry Prohibition Act. It has been submitted on behalf of petitioner that at the time of marriage, he was minor and now, complainant is married to some other person and she is residing with him. It is further submitted that inspite of the court's notice, complainant is not appearing before the Court.

Heard learned A.P.P. also.

Having heard both sides. It appears from the

Patna High Court Cr.Misc. No.8182 of 2017 (3) dt.20-03-2017 2/2 impugned order that complainant is not appearing before the Court, however, the petitioner is ready to settle the matter. In such view of the matter, let the petitioner named above, in the event of his arrest or surrender in the court within a period of two weeks from the date of receipt/ production of a copy of this order, be released on provisional bail for six months on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Sherghatti in connection with complaint case no. 636 of 2008, subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure and in the meantime, call upon the opposite party no.

2 for mediation and for final settlement or for any other order and after six months on seeing the conduct of the petitioner, the provisional bail of the petitioner shall be confirmed to the satisfaction of learned lower court. It is needless to say that if opposite party no. 2 will not ready to cooperate in the mediation, then the bail bonds of the petitioner will be confirmed by the court concerned. With these observations, this bail application is disposed of.
