The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 380, 388, 389, 413, 415, 420, 467, 468, 469, 471, 474 and 475 of the Indian Penal Code.

The prosecution case is that the petitioner along with other co-accused persons used to demand extortion from the vendor of the sand ghat.

It is submitted by learned counsel for the petitioner that the petitioner has maliciously been roped in the present case and even assuming the case to be true no case under Section 384 of the I.P.C. is made out. It is further submitted that the petitioner

It is submitted by learned APP for the State that there is specific accusation of demanding extortion money against the petitioner in the FIR.

Considering the nature of accusation coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner abovenamed be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhagalpur, in connection with Complaint Case No.691 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
