The petitioner being husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken under Section 498A of the Indian Penal Code and section 4 of Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.
The marriage between the petitioner and the
Patna High Court Cr.Misc. No.34134 of 2015 (3) dt.26-11-2015 2/3 complainant is not in dispute. The petitioner and the complainant are present in court.
It is submitted by the learned counsel for the petitioner that the petitioner is aggrieved due to the fact that prior to the marriage a different girl was shown and he was cheated by getting the marriage performed with the complainant who is not the same girl who was shown to the petitioner.
Learned counsel for the complainant submits that the petitioner never complained till four years of marriage but when the present case has been filed, a lame excuse has been taken. The complainant is ready to resume the conjugal life. Learned counsel for the petitioner submits that the petitioner is not ready to accept the offer of the complainant.
In the circumstances, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Buxar Complaint Case No. 393C of 2014 pending in the court of learned SDJM, Buxar.
