Mr.Ashraf Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-07-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Petitioners apprehend their arrest in connection with Amarpur P.S. Case No.552 of 2018 for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 325, 307, 385, 504, 506 of the Indian Penal Code.

The allegation against the petitioners is that petitioners along with other accused persons asssautled four members of the family of the informant causing them injuries. Learned counsel for the petitioners submits that there is general and omnibus allegations against the petitioners. Learned counsel further submits that there was dispute with

Patna High Court CR. MISC. No.17795 of 2019(4) dt.18-07-2019 2/3 regard to purchase of some articles from the shop of the informant as both the parties are living in the same village. Learned counsel further submits that complaint was also lodged by the petitioner against the complainant and his family members alleging sub-standard goods were given by the complainant and upon protest, they assaulted the petitioners. Learned counsel for the petitioners further refers Annexure '3' series which is injury report of four persons and from perusal of the same, it appears that the injury caused to them are minor in nature by hard and blunt substance.

After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and taking into consideration the fact that there is case and counter case between the parties and the parties belong to the same village and the injury caused is minor in nature, as such, I am inclined to grant anticipatory bail to the petitioner. Accordingly, both the petitioners, named above, are directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.
