JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323,467 and 120B of the Indian Penal Code.

The prosecution case is that co accused Suman Kumar executed two sale deeds with regard to the land falling in the share of the complainant in favour of the petitioners. It is submitted by the learned counsel for the petitioners that the petitioners have purchased the land from co accused Suman Kumar after making payment of consideration amount and

Patna High Court Cr.Misc. No.36454 of 2015 (2) dt.09-09-2015 2/2 Suman Kumar has sold his share of land to the petitioners. Statement to that effect has been made in paragraphs 9 and 10 of the petition.

Considering the nature of accusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Madhepura in connection with Complaint Case No. 1068C of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
