JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in Comp. Case No.846 of 2000, Tr.No.2063 of 2016 instituted for the offence under Sections 498A, 504 and 506 of the Indian Penal Code and Section 3 of the D.P. Act.
It has been submitted on behalf of the petitioner that the complainant is already dead.
From the impugned order it appears that earlier the prayer for anticipatory bail of the petitioner was rejected by order dated 16.4.2008 passed in A.B.P. No.171 of 2008. Thereafter, petitioner filed fresh anticipatory bail petition with compromise petition filed by the brother of the complainant.
Patna High Court Cr.Misc. No.3561 of 2017 (2) dt.09-02-2017 The Sessions Judge has rejected his anticipatory bail petition with a direction to surrender before the learned court below and seek regular bail.
This Court does not find any irregularity in the aforesaid order. The petitioner may surrender in the court below and make prayer for regular bail within a period of four weeks from today along with compromise petition which shall be disposed of by the court below in accordance with law, if possible, on the same day itself.
