This application for anticipatory bail, arises out of Chapra Town Police Station Case No. 512 of 2016, disclosing offences punishable under Sections 498-A, 304-B and 120-B of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The petitioner is mother-in-law of the deceased. Learned counsel for the petitioner has submitted that the petitioner was allowed privilege of anticipatory bail by the court below till submission of the charge-sheet and now charge-sheet has been submitted. He accordingly submits that she apprehends her arrest.

No.21022 of 2019(2) dt.04-04-2019 2/2 Since the petitioner has been allowed anticipatory bail and there does not appear to be any material to suggest that she, however, misused the privilege of bail, it is directed that if the petitioner, above-named, is sought to be arrested, she shall be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town Police Station Case No. 512 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
