Mr.Zainul Abedin ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Punaura P.S. Case No. 187 of 2019 for the offence under Sections 457, 380, 411/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 18.11.2019.

Referring to the prosecution case, learned counsel for the petitioner submits that the allegation against the petitioner is that he was among the persons, who entered into the house of the informant and removed three boxes containing clothes, ornaments and Rs.1500/- cash. He further submits that nothing has been recovered from the possession of the petitioner to connect him in the commission of crime.

No.17562 of 2020(2) dt.02-06-2020 2/2 Considering the fact that the petitioner has got no criminal antecedent and he is in custody since 18.11.2019, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate I/c, Sitamarhi in connection with Punaura P.S. Case No. 187 of 2019 with the condition that the petitioner on release will render his service as volunteer for a period of three months in dedicated Covid Hospital.
